These Terms of Use (“Terms”) govern your access to and use of Level Up Dating (the “Website,” “Service,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that the information you provide is accurate.
2. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep your profile information up to date.
We may suspend or terminate accounts that violate these Terms or that we believe may pose a safety risk to other users.
3. Community Standards and Prohibited Content
Level Up Dating is intended to support respectful, intentional connections. You agree not to post, upload, share, transmit, or otherwise make available any content that:
Is sexually explicit, pornographic, or contains nudity intended for sexual arousal
Is abusive, harassing, hateful, threatening, violent, or encourages harm
Is exploitative, non-consensual, or includes intimate imagery of others without permission
Depicts minors in any sexual context or otherwise violates child safety laws (this will be reported)
Is discriminatory or promotes hate based on protected characteristics
Includes graphic violence, self-harm content, or illegal activity
Contains malware, spam, scams, phishing attempts, or deceptive content
Infringes on any third-party rights (copyright, trademark, privacy, publicity, etc.)
Impersonates another person or misrepresents your identity
We reserve the right to remove content and/or restrict accounts that violate these rules.
4. User Conduct
You agree to use the Service respectfully and lawfully. You must not:
Harass, stalk, intimidate, or threaten other users
Share another person’s private information without their consent
Attempt to access accounts or systems you are not authorized to access
Scrape, copy, or harvest user data or content
Use the Service for commercial solicitation, advertising, or recruiting without permission
5. Reporting and Safety
If you encounter behavior or content that violates these Terms, please report it through the reporting tools available on the Service. We review reports and may take action at our discretion, including warnings, content removal, suspension, or termination.
6. Content You Post (Your Rights and Our Limited License)
You retain ownership of the content you submit (such as profile text and photos). By posting content to the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content only as needed to operate and provide the Service (for example, showing your profile to other users). This license ends when you delete your content or your account, except where storage is required for legal, safety, or technical reasons (e.g., backups or investigations).
We do not sell your photos or data
We do not sell your photos or personal information, and we do not use your photos or data for sale to advertisers.
7. Privacy
Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.
8. Account Deletion
You can delete your account at any time from your account settings. Upon deletion, your profile will no longer be visible on the Service. Some information may remain in backups for a limited period or as required for legal, safety, or fraud-prevention purposes.
9. Service Changes and Availability
We may modify, suspend, or discontinue any part of the Service at any time, including features, pricing (if applicable), or availability. We are not liable for any interruption or loss of access.
10. Disclaimers
The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, error-free, or that any particular user experience or relationship outcome will result from using the Service.
We are not responsible for the conduct of users on or off the Service. Use your judgment and take appropriate precautions when meeting others.
11. Limitation of Liability
To the fullest extent permitted by law, Level Up Dating and its owners, operators, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service.
12. Indemnification
You agree to defend, indemnify, and hold harmless Level Up Dating and its owners, operators, and affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.
13. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or if we believe your conduct may harm the Service or other users. You may stop using the Service and delete your account at any time.
14. Governing Law
These Terms are governed by the laws of (Toronto, Ontario, Canada), without regard to conflict of laws principles. Any disputes will be handled in the courts located in (the courts of the Province of Ontario, sitting in Toronto), unless applicable law requires otherwise.
